INTRODUCTION: This page states the "Terms and Conditions" under which you may use Federal Career Placement Services LC. (FCPS). Please read this page carefully. If you do not accept the Terms and Conditions stated here do not use this Web Site and service. By using this Web Site, you are indicating your acceptance to be bound by the terms of these Terms and Conditions. FCPS may revise these Terms and Conditions at any time by revising this posting. You should visit this page periodically to review the Terms and Conditions, because they are binding on you. The terms "Client" and "Customer" as used herein refer to all individuals and/or entities accessing this web site for any reason.


1. THE SERVICE The Service consists of engaging Federal Career Placement Services, LC (FCPS) to represent a client in the following matter only: during an effort to obtain federal civil service employment within the defense intelligence community in accordance with the Fee Structure and Category of Services for a period as specified by the desired services the Client provides compensation for. The Client is responsible for obtaining and maintaining all computer hardware, software and communications equipment needed to access the Service, and for paying all third-party access charges (e.g., kiosk, ISP, telecommunications, PayPal) incurred while using the Service. FCPS makes no guarantees as to the continuous availability of the Service or of any specific feature(s) of the Service. FCPS reserves the right to change the Service or the terms and conditions of this Agreement at any time without notice.


2. CLIENT SUBMISSIONS As a Client, you are responsible for your own communications and are responsible for the consequences of their posting. You must not, and by using this Web Site you agree not to, do the following things: post or provide material that is copyrighted, unless you are the copyright owner or have the permission of the copyright owner to post it; post material that reveals trade secrets, unless you own them or have the permission of the owner; post material that infringes on any other intellectual property rights of others or on the privacy or publicity rights of others; post material that is obscene, defamatory, threatening, harassing, abusive, hateful, or embarrassing to another user or any other person or entity; post a sexually- explicit image or statement; post advertisements or solicitations of business, post chain letters or pyramid schemes; impersonate another person; or post material that contains viruses, Trojan horses, worms, time bombs, cancelbots or other computer programming routines or engines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or information. FCPS does not represent or guarantee the truthfulness, accuracy, or reliability of communications posted by users or endorse any opinions expressed by users. You acknowledge that any reliance on material posted by other users will be at your own risk. FCPS acts as a passive conduct for the online distribution and publication of user-submitted information and has no obligation to screen communications or information in advance and is not responsible for screening or monitoring material posted by users. If notified by a user of communications which allegedly do not conform to these Terms and Conditions, FCPS may investigate the allegation and determine in good faith and its sole discretion whether to remove or request the removal of the communication. FCPS has no liability or responsibility to users for performance or nonperformance of such activities. FCPS reserves the right to expel users and prevent their further access to the Web Site for violating the Terms and Conditions or the law and the right to remove communications which are abusive, illegal, or disruptive. FCPS may take any action with respect to user-submitted information that it deems necessary or appropriate in its sole discretion if it believes it may create liability for FCPS or may cause FCPS to lose (in whole or in part) the services of its ISPs or other suppliers. By submitting content to any public or non-public area of the Web Site, including message boards, forums, contests and chat rooms, you grant FCPS the loyalty-free, perpetual, irrevocable, sublicenseable (through multiple tiers), non-exclusive right (including any moral rights) and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, communicate to the public, perform and display the content (in whole or in part) worldwide and/or to incorporate it in other works in any form, media, or technology now known or later developed, for the full term of any rights that may exist in such content. You also warrant that the holder of any rights, including moral rights in such content, has completely and effectively waived all such rights and validly and irrevocably granted to you the right to grant the license stated above. 3. ACCEPTABLE SITE USE (a) Specific Prohibited Uses. FCPS may be used only for lawful purposes by individuals seeking employment. FCPS specifically prohibits any use of this Site, and requires all users to agree not to use this Site, for any of the following: (i) Do Not provide to FCPS any incomplete, false or inaccurate resume information or information which is not your own accurate resume (living individual seeking employment on a full-time or part-time basis on his or her own behalf). Do not post non-resume information such as opinions or notices, commercial or otherwise. Headhunters, employment placement/outplacement agencies, temporary worker agencies, consultants and other third parties, including any third party charging a fee or restricting complete access to all resume information, are prohibited. (ii) Do Not post to FCPS any franchise, pyramid scheme, "club membership", distributorship or sales representative agency arrangement or other business opportunity which requires an up front or periodic payment, pays commissions only (no significant salary), requires recruitment of other members, sub-distributors or sub-agents. (iv) Do Not delete or revise any material posted by any other person or entity. (v) Do Not print out or otherwise copy or use any personally identifiable information about employees or business information about employers. Unsolicited e-mail, telephone calls, mailings or other contacts to posting individuals and companies are prohibited. (b) Web Site Security Rules. Clients are prohibited from violating or attempting to violate the security of FCPS, including, without limitation, (a) accessing data not intended for such user or logging into a server or account which such user is not authorized to access, (b) attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization,(c) attempting to interfere with service to any user, host or network, including, without limitation, via means of overloading, "flooding", "mailbombing" or "crashing", or (d) sending unsolicited e-mail, including promotions and/or advertising of products or services, or (e) forging any FCPS packet header or any part of the header information in any e-mail or newsgroup posting. Violations of system or network security may result in civil or criminal liability. FCPS will investigate occurrences which may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting users who are involved in such violations. (c) General Rules. Users may not use this Site in order to transmit, distribute, store or destroy material (a) in violation of any applicable law or regulation, (b) in a manner that will infringe the copyright, trademark, trade secret or other intellectual property rights of others or violate the privacy or publicity or other personal rights of others, or (c) that is libelous obscene, threatening, abusive or hateful.


4. USER INFORMATION When you submit a contact request within our “Contact Us” web page you will be asked to provide FCPS with certain information including, without limitation, a valid email address (your "Information"). In addition to the terms and conditions that may be set forth in any privacy policy on this Web Site, you understand and agree that FCPS may disclose to third parties, on an anonymous basis, certain aggregate information contained in your request. FCPS reserves the right to offer third party services and products to you based on the preferences that you identify in your registration and at any time thereafter; such offers may be made by FCPS or by third parties. FCPS may also send to you via email an informative newsletter or tips on using the services offered. Please see FCPS's Privacy Policy for further details regarding your Information.


5. PAYMENT OF FEES (NOT APPLICABLE TO FREE SERVICE) If you elect to purchase Limited Category or Full Service Category services, you agree to provide FCPS with accurate and complete billing information, including your legal name, address and telephone number, and to update this information within 30 days of any change to it. Payment by fraudulent means will result in immediate and permanent termination of the account, and possible criminal penalties. Upon signing up for additional services, you will pay FCPS, by authorized credit card, personal check or certified money order, the then applicable fees (the "Fees"). Currently applicable Fees are available at the Web Site. The Web Site reserves the right to change the Fees or applicable charges and to institute new charges at any time, upon thirty (30) days prior notice to you (which may be sent by email). The Fees will automatically be charged annually or according to subscription, in advance. Your FCPS account will be considered delinquent if your credit card company refuses for any reason to pay the amount billed to it and that amount remains unpaid at the beginning of the next accounting cycle. The additional services may be suspended, archived or purged from system if account is delinquent for more than one billing cycle. FCPS may impose a charge to restore archived data from delinquent accounts. If you believe FCPS has billed you incorrectly, you must contact FCPS no later than 60 days after the closing date on the first billing statement in which the error or problem appeared, in order to receive an adjustment or credit. Inquiries should be directed to FCPS's Customer Support department. FCPS may choose to bill through an invoice, in which case, full payment for invoices issued in any given month must be received by FCPS thirty (30) days after the mailing date of the invoice, or the Service may be terminated. Unpaid invoices are subject to interest of 1.5% per month on any outstanding balance, or the maximum permitted by law, plus all expenses of collection. (a) All time, including the Organization’s advertised job Vacancy Announcement (VA) monitoring, online job application preparation and submission, in person applicant collaboration or correspondence via e-mail or telephonic means, interview preparation and salary negotiation strategy development will be inclusively billed within category and rate pricing. See current pricing for rates for various categories of personal services that are currently in effect: Category [Limited Service] . Resume Preparation Only . Interview Preparation Only [2-hour Session] . Review, Edit and/or Prepare one on-line KSA Response . Review, Edit and/or Prepare one DISL/DISES ECQ Response . Review, Edit and/or Prepare one Complete on-line VA Response [Resume plus KSA package deal] Category [Full Service] 6-Tier Rate . Pay Band ELP-02 VA Application Support . Pay Band 04/GS/GG-13/14 VA Application Support . Pay Band 05/GS/GG-15 VA Application Support Flat Rate fees for limited service category items are payable in full at time of contract signing and are non refundable. There is a maximum limit of twenty [20] hours chargeable per item per fee payment for resume preparation, application reviews and KSA building. FCPS allocates [30] hours maximum limit chargeable per item per fee payment for ECQ response preparation due to their difficulty and complexity. Interview preparation is allocated two (2) hours time spent in telephonic or face-to-face discussion per item/instance purchased. 6-Tier value package fees are payable and described as follows. One sixth rate per category is due at time of contract signing and is non refundable. The remaining 5/6th rate per category is due thirty (30) days after the 6-Tier contract between Client and Seller became officially binding and is non refundable. *FCPS Full Service category contract clients are eligible to receive FCPS support for up to ten [10] individual vacancy announcement submissions during the six month period of contract. There is a maximum time limit of 180 days per full service category contract signed. 10% discount available for qualified military members only on full service value package services. Valid coupons and discounts will be deducted at time of payment. Rates will remain in effect and will not be adjusted to reflect changes in the cost-of-living index as published. Unless otherwise stated, all cost estimates presented in this proposal constitute a fixed price. (b) Non Reimbursable Expenses. Client travel expenses necessary for the execution of the project, including a Client’s rail, taxi, bus, air, rental vehicles, highway mileage in company or personal vehicles necessary to attend Federal Agency job interviews. Client costs associated with meeting the Seller in the Washington D.C. area at a mutually agreeable location to conduct personal consultations and interview preparation if done face-to-face. Client costs associated with all Federal Agency requirements applicable to conditionally selected candidates such as thorough background inquiry appointments, required medical examinations, initial counterintelligence or full-scope polygraph testing, urinalysis screening for illegal drugs or any other Federal Agency-mandated requirement. Client costs associated with internet service or making telephonic phone calls to the Seller. Client costs associated with purchasing appropriate clothing attire and accessories necessary to conduct a successful interview. The following expenses will be billed at direct cost: . Flat Rate Fees for Limited Service Categories. Initial and Subsequent 6-Tier Rate Fees for Full Services Categories. Other project expenses as proposed by the Client and mutually agreed to by the Seller.


6. FCPS'S LIABILITY: FCPS is only a venue. This Web Site acts as a venue for clients to obtain federal government employment and does not screen or censor the listings offered. FCPS is not involved in the actual transaction between employers and candidates. As a result, FCPS has no control over the quality, safety or legality of the jobs or resumes posted, the truth or accuracy of the listings, the ability of employers to offer job opportunities to candidates or the ability of candidates to fill job openings. In addition, note that there are risks, including but not limited to the risk of physical harm, of dealing with strangers, foreign nationals, underage persons or people acting under false pretenses. You assume all risks associated with dealing with other users with whom you come in contact through the Web Site. Because user authentication on the Internet is difficult, FCPS cannot and does not confirm that each user is who they claim to be. Because we do not and cannot be involved in user-to-user dealings or control the behavior of participants on FCPS, in the event that you have a dispute with one or more users, you release FCPS (and our agents and employees) from claims, demands and damages (actual and consequential, direct and indirect) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes. We are under no legal obligation to, and generally do not, control the information provided by other users which is made available through the Web Site. By its very nature, other people's information may be offensive, harmful or inaccurate, and in some cases will be mislabeled or deceptively labeled. FCPS certifies that we are not affiliated with, represented by, or otherwise associated with the Defense Intelligence Agency, Department of Defense (DoD) or United States Government (USG). FCPS further attests that our career placement services do not knowingly use the words “Defense Intelligence Agency”, the initials “DIA”, or the seal of the Defense Intelligence Agency, in connection with any merchandise, retail product, impersonation, solicitation, or commercial activity in a manner reasonably calculated to convey the impression that such use is approved, endorsed, or authorized by the Secretary of Defense, the Director of National Intelligence (DNI) and the Director Defense Intelligence Agency iaw Federal Law, Title 10 U.S. Code 425.


10. MISCELLANEOUS: The failure of either party to exercise in any respect any right provided for herein will not be deemed a waiver of any further rights hereunder. If any provision of this Service Agreement is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that this Service Agreement will otherwise remain in full force and effect and enforceable. This Service Agreement is not assignable, transferable or sublicensable by you except with FCPS's prior written consent. This Service Agreement will be governed by and construed in accordance with the laws of the state of Virginia without regard to the conflict of laws provisions thereof. Both parties agree that this Service Agreement is the complete and exclusive statement of the mutual understanding of the parties and supersedes and cancels all previous written and oral agreements, communications and other understandings relating to the subject matter of this Service Agreement, and that all modifications must be in a writing signed by both parties, except as otherwise provided herein. No agency, partnership, joint venture, or employment is created as a result of this Service Agreement and you do not have any authority of any kind to bind FCPS in any respect whatsoever. In any action or proceeding to enforce rights under this Service Agreement, the prevailing party will be entitled to recover costs and attorneys' fees. All notices under this Service Agreement will be in writing and will be deemed to have been duly given when received, if personally delivered; when receipt is electronically confirmed, if transmitted by facsimile or e-mail; the day after it is sent, if sent for next day delivery by recognized overnight delivery service; and upon receipt, if sent by certified or registered mail, return receipt requested.


11. PRIVACY: Personally identifiable information provided to FCPS for its use in the FCPS resume database is confidential and may be viewed only by us and not anyone with unauthorized access to the Site. If users submit personally identifiable information to the FCPS resume database, it may not be viewed by any employers. We may use the information to contact you about our employment services. FCPS cannot police or enforce its rules against all third party users; you should communicate with any user if you object to being contacted and want to restrict or stop their use. If you want FCPS to remove your resume or to cease any other internal use of personally identifiable information, you should send us a specific request by certified mail or by regular mail clearly marked "Privacy-Urgent", in either case, addressed as follows: P.O Box 263, Stafford VA, 22554. You may send you request by e-mail to fcpslc@live.com at the Web Site but due to the volume of e-mail we receive, it may not secure prompt attention. VACANCY ANNOUNCEMENT POSTING AND PLACEMENT RULES Acceptance: By purchasing FCPS services, you acknowledge reading and accepting these Terms and Conditions and you represent, warrant and agree that you are not in violation of Rules. You further agree that FCPS has the right to recommend editing the content of your Vacancy Announcement draft submissions and to reject or terminate Client proposals that do not meet our standards. 1. FCPS reviews and attempts to place Clients into all federal job vacancies accross the entire federal government and focuses towards defense intelligence job category positions being posted by one particular organization; all are Equal Opportunity Employers. All federal organizations follow EEO guidelines of providing equal opportunity for employment for all qualified persons regardless of race, color, creed, national origin, religion, age, sex, disability or veteran status in recruiting, hiring, placement, assignment to work tasks, hours of employment, levels of responsibility and pay. 2. FCPS reviews all federal job postings that must be for current (real) job openings. 3. All job postings reviewed are for federal service direct hire positions. Potential employees and FCPS clients must be eligibility criteria as stated by the organization. 4. The Web Site does not review and attempt to place Clients into job postings for positions we consider outside the scope of acceptable business enterprise. Examples of positions that FCPS is not currently reviewing with at the present time in an attempt to place its Clients are contractor or private sector positions outside the federal government. 5. Cancellations, Refunds & Chargebacks: (a) Cancellations: No cancellations or refunds are accepted for any reason. By clicking submit and purchasing our service you are entering into a legally binding agreement with us to deliver our services. We offer very strong guarantees and cannot stand behind them unless you give us a chance to actually deliver them to you. After receiving our service we will always stand behind our guarantee. Which is: we will revise to a Client’s satisfaction their standard on-line resume if they notify us within 30 days of receipt. (b) Fraudulent claims: Should you make fraudulent credits, statements, actions, or cancellations relating to this order or the billing for your order, we will automatically charge you a $50 processing fee plus the maximum amount of damages allowed by law for each occurrence and any guarantee will be voided. Furthermore, we will report the fraudulent activity to your ISP and applicable law enforcement authorities. RESUME RELATED RULES Acceptance: By purchasing any of our resume related services (resume writing, resume distribution and related services), you acknowledge reading and accepting these Terms and Conditions and you represent, warrant and agree that you are not in violation of our terms of use listed on this page. You further agree that, should you violate any of these terms you will cause us damages equal to or greater than the amount of your current purchase, which will be forfeited. You further agree that the Web Site has the right to edit the content of your resume based upon the recommendations of our professional resume writers. [Historical data at the time of this contract signing illustrates all Client contracts for this service have been completed by the Seller within the prescribed twenty [20] hour time limit.] (b) Procedures for Approving your Resume After you submit all the required information for your resume you will be provided a final draft for your approval. You have 3 business days to review the accuracy of your documents. After 3 business days your resume writing order will be closed and your order will be complete. Also at this time you will be advised to submit your resume in accordance with vacancy announcement closing timelines if the Client has requested a resume in support of a specific vacancy announcement. It remains the Client’s sole responsibility to ensure their resume is submitted on time and to the organization through its employment opportunity web site. (c) Information to be Included in your Resume Your resume can only be written based upon the information you send to us. All information you submit in compliance with the timing of sections 1 and 2 above will be included in your resume. If you fail to submit the correct information or omit information needed for your resume FCPS is not obligated to include this information after your resume has already been written. Should you wish to have this information included after your order is complete, limited category service Clients will have to pay an additional re-write fee. Full Service category clients who have paid in good standing may submit additional information at any point during their 365-day contract period and FCPS will add it to their existing on-line resume. It remains the Client’s responsibility to then submit changes to any federal on line organization/agency’s employment web site using their personal applicant home account. (d) Guarantees Our Federal Resume Writing Guarantee: If after reviewing your new resume used on a federal government agency/organization’s on-line personal account for 30 days you aren't satisfied with its content, FCPS will have your resume re-written for no charge and return to you a revised version within 14 business days. If for any reason your resume is not accepted by our targeted defense intelligence organization based on compliance, we will rewrite your resume at no cost to you. Important Notice: We take credit card fraud (including fraudulent chargebacks) very seriously. Every order is logged with complete contact information (including your computers internet IP address). Any attempt at fraud or fraudulent chargebacks will be reported to the appropriate law enforcement authorities and your ISP.


16. INTERVIEW PREPARATION SESSION. (a) Seller will expend up to a maximum of two [2] hours in one session assisting Client to prepare for an interview. This may be done in response to a notification to the Client by the Organization to arrange an interview, or may be done separately for Client preparation technique enhancement during interviews. Client and Seller will meet at a mutually agreeable location within the Washington D.C. area, or arrange for telephonic discussions for the purpose of conducting intensive interview preparation activities. (b) Client must notify the Seller within 12 hours of an interview preparation session appointment start time if they need to reschedule for any reason. The Client’s failure to notify Seller will constitute forfeiture of fee and require a subsequent payment, if Seller decides it is not possible to meet Client’s last minute request. In-person or telephonic interview preparation sessions will include as a minimum the following items. . Clothing, apparel and accessories. . Interview session scenario. . Probable Interview questions. . Interview techniques.


17. PREPARE ONE ON-LINE KSA APPLICATION: Seller will expend up to a maximum of twenty [20] hours reviewing or preparing a Client’s draft* on line job application to ensure it enables the Client to effectively compete and be considered for further referral, interview call and selection. Seller will either review a Client draft KSA write-up or prepare responses for one Organizational vacancy announcement. Seller reviews and incorporates substantive and contextual value, corresponds with Client via e-mail as required to optimize information presentation, and fine tunes Client’s draft KSAs to make it as competitive as possible. Seller provides Client an exclusive advantage by shaping the Client’s submission to satisfy formal as well as unspoken cultural submission criteria hiring and review board officials use. Seller will prepare responses for each mandatory and highly desired assessment factor listed for the VA. Seller’s responsibilities are completed when the Client’s on line job application is ready for final submission prior to the position’s announced closing date or twenty [20] hours have been expended in support of this service.


18. REVIEW, EDIT AND/OR PREPARE ONE COMPLETE ON-LINE RESPONSE. Seller affords FCPS Clients a $100.00 savings by reviewing or preparing in its entirety one complete draft vacancy announcement packet submission. 19. EXECUTIVE CORE COMPETENCY [ECQ] PREPARATION. Seller will expend up to thirty [30] hours preparing one Executive Position [DISL/DISES] Essential Factors and Highly Desired Factors submission. Seller will correspond with Client via telephone or e-mail to request from Client all relevant background information in order to prepare focused responses for each essential and highly desired factor. Seller will prepare responses iaw Office of Personnel Management (OPM) Guide to SES Qualifications and shape responses in conjunction with known Federal Agency contextual preferences. Seller will provide Client draft ECQs for review responsibilities within fourteen business days and/or thirty [30] hours have been expended in support of this service.


20. FULL SERVICE CATEGORY SUPPORT. FCPS provides turn-key, cradle-to-grave support to paying clients. In 2008 DoD intelligence transitioned from the legacy Government Service Grade / Step system to the Defense Civilian Intelligence Personnel System (DCIPS). Efforts to obtain employment at each increasing pay band clearly require a corresponding increase in effort, proficiency in preparing demanding Assessment Factors, man hours applied to Client job application preparation, and interview techniques. The Seller will assist the Client’s to obtain employment, as well as compete effectively at the highest possible pay band. (a) FCPS will reply to a Client’s initial correspondence to understand their employment goals and aspirations. The Seller will solicit basic information that will assist in an understanding of the Client’s potential for employment at the targeted defense intelligence Organization and all client desired federal agencies. Clients shall provide elementary categories of information and shall respond to several Seller inquiries. At this point in the process, the Seller shall advise the Client of the following upon receiving feedback to select inquisitions. . If the Client appears to be deemed potentially employable in defense intelligence or the federal government due to national origin, previous criminal activity, drug use or personal behavior, medical or psychological conditions, education and experience. Which pay band and work level the Seller believes the Client could effectively compete at while attempting to gain federal employment. Which job categories the Seller believes the Client can compete towards. Note: The Seller has been very successful marketing Clients to obtain employment at a defense intelligence community Organization and other federal Agencies in a number of categories outside the Client’s initial skill preference category or Pay Band [Grade] assumptions. (b) The Seller primarily provides services that assist Client efforts to obtain employment in the Washington D.C. area. The Seller operates and physically conducts Client support activities in the Washington D.C. area, but effectively and routinely corresponds with Clients worldwide to facilitate their long distance efforts to relocate to the Washington D.C. area. Clients shall make all necessary arrangements to attend interviews or travel accordingly. The Seller also assists Client efforts to obtain employment worldwide, frequently at Combatant Command (COCOM) and Federal Agency headquarters locations where the federal government maintains sizeable presence. It remains the Client’s responsibility to make all arrangements for travel accordingly. (c) The Client may take as long as they desire to review FCPS service offerings and shall make all necessary payment at the time of contract submission to obtain services for desired categories of support. The contract will become officially binding between the Client and the Seller upon the date that the Client’s payment clears a financial institution chosen by the Seller. The Seller will begin correspondence and support to comply with this agreement and services purchased thereafter. (d) Once a Client’s payment has been formally received and cleared financial institution processing, the Client shall immediately create an applicant account on the Organization’s official applicant log-in page at the following URL. https://diajobs.dia.mil/psp/recnprod/APPLICANT/HRMS/c/DI_HOME.DI_SIGNIN.USF if they desire to attempt to obtain federal employment at this particular organization. Otherwise, they will create an account at their preferred federal Agency if the respective agency requires them to do so. (e) This will ensure the Client enables the Seller to immediately begin providing support. On behalf of the Client, the Seller will view job posting vacancy announcements, identify those applicable to the Client, and begin preparation of multiple draft applications. Corresponding on a continuous basis with and only with the Client, the Seller will prepare up to ten [10] applications on behalf of the full service Client during and in accordance with the period of contract. The Seller will notify the Client when draft applications are ready for the Client’s final review and submission, highlighting mandatory closing dates and if any additional information is still required from the Client to complete the application. For clients desiring employment at the FCPS targeted organization, It is their responsibility to submit all final draft applications in accordance with Step 14 [Submit Application Package] to the Organization [Apply for Job procedures].*** (f) The Client is solely responsible for submitting final draft applications in accordance with Step 14 [Submit Application Package] to the Organization’s “Apply for Job” procedures as outlined on its official web site. The Organization’s Personal Accountability Statement is a U.S. legally binding affirmation which states “Application data within Organization’s official automated recruitment system will be used by agency officials in their employment decisions. Submission of false, fictitious or fraudulent information is prohibited and can bring a fine or imprisonment of not more than 5 years (18 USC 1001).” The Seller will not assume any responsibility on behalf of the Client regarding the Client’s submitted information. Additionally, it is the Client’s sole responsibility to be responsive to the Seller’s guidance, recommendations and correspondence that will advise the Client of mandatory submission closing dates. The Client’s failure to submit job vacancy applications in accordance with the mandatory closing date will be the fault of the Client alone, and not be held against the Seller as a breach of contract. (g) The Client is responsible for monitoring his email address that the Organization will use to provide notification updates to job application status changes. Upon Client notification by the Organization or any other federal agency via e-mail or telephonically that the Client has been selected for an interview, the Client shall correspond immediately with the Seller to prepare and arrange for an interview preparation session if they desire this service. The Seller will be responsive to the Client and facilitate arrangement for an in person or telephonic meeting to provide services to the Client in accordance with established guidelines. It is the Client’s responsibility to arrange and pay for long distance phone charges or internet service fees if a telephonic or VOIP interview up to two [2] hours is desired instead of a face to face meeting in the Washington D.C. area regardless of which category of services is obtained. The Seller is not liable for a Client’s failure to obtain employment under any circumstance. (h) Upon Client notification by the organization that they have been selected for a position within the federal Agency and is being offered conditional employment, they may consider an opportunity to consider the offer and request advice from FCPS. This Client is solely responsible for entering into all salary negotiations with an organization and FCPS is not responsible in any manner if they lose a job offer or do not obtain desired salary amounts. FCPS will provide recommendations to full service category Clients for helping them attempt to obtain a higher rate of starting salary within the offered Pay Band or additional incentives. The Client may then call back the organizational representative and request a counter offer if they desire to do so. At any time the Client may agree to any salary offers at their discretion. (i) Upon accepting a conditional job offer with the Organization the Client will comply with all prerequisites to obtain employment. Full Service Clients may continue to receive additional notifications from the Organization in response to other previously submitted applications and may contact the Seller to conduct additional interview preparation sessions during their 180 day period of contract. It is to the Client’s advantage to continue their attempts to obtain higher Pay Band conditional job offers until either this contract of services expires, or the Client formally reports for employee in processing upon completing all conditional job offer prerequisites. (j) The Client may terminate this contract of services at any point in time on a non refundable basis. The Seller is bound by this contract of services and may not unilaterally terminate it prior to its stated completion unless the Client violates provisions stated herein.

The Client is responsible for obtaining and maintaining all computer hardware, software and communications equipment needed to access the Service, and for paying all third-party access charges (e.g., kiosk, ISP, telecommunications, PayPal) incurred while using the Service. FCPS makes no guarantees as to the continuous availability of the Service or of any specific feature(s) of the Service. FCPS reserves the right to change the Service or the terms and conditions of this Agreement at any time without notice.


2. CLIENT SUBMISSIONS As a Client, you are responsible for your own communications and are responsible for the consequences of their posting. Payment by fraudulent means will result in immediate and permanent termination of the account, and possible criminal penalties. Your FCPS account will be considered delinquent if your credit card company refuses for any reason to pay the amount billed to it and that amount remains unpaid at the beginning of the next accounting cycle. The additional services may be suspended, archived or purged from system if account is delinquent for more than one billing cycle. FCPS may impose a charge to restore archived data from delinquent accounts. If you believe FCPS has billed you incorrectly, you must contact FCPS no later than 60 days after the closing date on the first billing statement in which the error or problem appeared, in order to receive an adjustment or credit. Inquiries should be directed to FCPS's Customer Support department. FCPS may choose to bill through an invoice, in which case, full payment for invoices issued in any given month must be received by FCPS thirty (30) days after the mailing date of the invoice, or the Service may be terminated. Unpaid invoices are subject to interest of 1.5% per month on any outstanding balance, or the maximum permitted by law, plus all expenses of collection. There is a maximum limit of twenty [20] hours chargeable per item per fee payment for resume preparation, application reviews and KSA building. FCPS allocates [30] hours maximum limit chargeable per item per fee payment for ECQ response preparation due to their difficulty and complexity. Interview preparation is allocated two (2) hours time spent in telephonic or face-to-face discussion per item/instance purchased. 6-Tier value package fees are payable and described as follows. One sixth rate per category is due at time of contract signing and is non refundable. The remaining 5/6th rate per category is due thirty (30) days after the 6-Tier contract between Client and Seller became officially binding and is non refundable. *FCPS Full Service category contract clients are eligible to receive FCPS support for up to ten [10] individual vacancy announcement submissions during the six month period of contract. There is a maximum time limit of 180 days per full service category contract signed. 10% discount available for qualified military members only on full service value package services. Valid coupons and discounts will be deducted at time of payment. Rates will remain in effect and will not be adjusted to reflect changes in the cost-of-living index as published. Unless otherwise stated, all cost estimates presented in this proposal constitute a fixed price. (b) Non Reimbursable Expenses. Client travel expenses necessary for the execution of the project, including a Client’s rail, taxi, bus, air, rental vehicles, highway mileage in company or personal vehicles necessary to attend Federal Agency job interviews. Client costs associated with meeting the Seller in the Washington D.C. area at a mutually agreeable location to conduct personal consultations and interview preparation if done face-to-face. Client costs associated with all Federal Agency requirements applicable to conditionally selected candidates such as thorough background inquiry appointments, required medical examinations, initial counterintelligence or full-scope polygraph testing, urinalysis screening for illegal drugs or any other Federal Agency-mandated requirement. Client costs associated with internet service or making telephonic phone calls to the Seller. Client costs associated with purchasing appropriate clothing attire and accessories necessary to conduct a successful interview. The following expenses will be billed at direct cost: . Flat Rate Fees for Limited Service Categories. Initial and Subsequent 6-Tier Rate Fees for Full Services Categories. Other project expenses as proposed by the Client and mutually agreed to by the Seller.


6. FCPS'S LIABILITY: FCPS is only a venue. This Web Site acts as a venue for clients to obtain federal government employment and does not screen or censor the listings offered. FCPS is not involved in the actual transaction between employers and candidates. As a result, FCPS has no control over the quality, safety or legality of the jobs or resumes posted, the truth or accuracy of the listings, the ability of employers to offer job opportunities to candidates or the ability of candidates to fill job openings. In addition, note that there are risks, including but not limited to the risk of physical harm, of dealing with strangers, foreign nationals, underage persons or people acting under false pretenses. You assume all risks associated with dealing with other users with whom you come in contact through the Web Site. Because user authentication on the Internet is difficult, FCPS cannot and does not confirm that each user is who they claim to be. This Service Agreement is not assignable, transferable or sublicensable by you except with FCPS's prior written consent. This Service Agreement will be governed by and construed in accordance with the laws of the state of Virginia without regard to the conflict of laws provisions thereof. Both parties agree that this Service Agreement is the complete and exclusive statement of the mutual understanding of the parties and supersedes and cancels all previous written and oral agreements, communications and other understandings relating to the subject matter of this Service Agreement, and that all modifications must be in a writing signed by both parties, except as otherwise provided herein. No agency, partnership, joint venture, or employment is created as a result of this Service Agreement and you do not have any authority of any kind to bind FCPS in any respect whatsoever. In any action or proceeding to enforce rights under this Service Agreement, the prevailing party will be entitled to recover costs and attorneys' fees. All notices under this Service Agreement will be in writing and will be deemed to have been duly given when received, if personally delivered; when receipt is electronically confirmed, if transmitted by facsimile or e-mail; the day after it is sent, if sent for next day delivery by recognized overnight delivery service; and upon receipt, if sent by certified or registered mail, return receipt requested.


11. PRIVACY: Personally identifiable information provided to FCPS for its use in the FCPS resume database is confidential and may be viewed only by us and not anyone with unauthorized access to the Site. If users submit personally identifiable information to the FCPS resume database, it may not be viewed by any employers. We may use the information to contact you about our employment services. FCPS cannot police or enforce its rules against all third party users; you should communicate with any user if you object to being contacted and want to restrict or stop their use. If you want FCPS to remove your resume or to cease any other internal use of personally identifiable information, you should send us a specific request by certified mail or by regular mail clearly marked "Privacy-Urgent", in either case, addressed as follows: P.O Box 263, Stafford VA, 22554. VACANCY ANNOUNCEMENT POSTING AND PLACEMENT RULES Acceptance: By purchasing FCPS services, you acknowledge reading and accepting these Terms and Conditions and you represent, warrant and agree that you are not in violation of Rules. You further agree that FCPS has the right to recommend editing the content of your Vacancy Announcement draft submissions and to reject or terminate Client proposals that do not meet our standards. 1. FCPS reviews and attempts to place Clients into all federal job vacancies accross the entire federal government and focuses towards defense intelligence job category positions being posted by one particular organization; all are Equal Opportunity Employers. All federal organizations follow EEO guidelines of providing equal opportunity for employment for all qualified persons regardless of race, color, creed, national origin, religion, age, sex, disability or veteran status in recruiting, hiring, placement, assignment to work tasks, hours of employment, levels of responsibility and pay. 2. FCPS reviews all federal job postings that must be for current (real) job openings. 3. All job postings reviewed are for federal service direct hire positions. Potential employees and FCPS clients must be eligibility criteria as stated by the organization. 4. The Web Site does not review and attempt to place Clients into job postings for positions we consider outside the scope of acceptable business enterprise. Examples of positions that FCPS is not currently reviewing with at the present time in an attempt to place its Clients are contractor or private sector positions outside the federal government. 5. Cancellations, Refunds & Chargebacks: (a) Cancellations: No cancellations or refunds are accepted for any reason. By clicking submit and purchasing our service you are entering into a legally binding agreement with us to deliver our services. We offer very strong guarantees and cannot stand behind them unless you give us a chance to actually deliver them to you. After receiving our service we will always stand behind our guarantee. Which is: we will revise to a Client’s satisfaction their standard on-line resume if they notify us within 30 days of receipt. (b) Fraudulent claims: Should you make fraudulent credits, statements, actions, or cancellations relating to this order or the billing for your order, we will automatically charge you a $50 processing fee plus the maximum amount of damages allowed by law for each occurrence and any guarantee will be voided. Furthermore, we will report the fraudulent activity to your ISP and applicable law enforcement authorities. Should we be unable to collect this fee we may report your account to a collection agency to collect it for us. (c) Forced Cancellations: Should you force us to cancel your order for any reason we will charge you a $50 processing fee in addition to any & all fees incurred on your order up to the time of the forced cancellation. The Web Site shall monitor daily postings of all jobs posted by its targeted defense intelligence comunity organization that are released on their official public web site in addition to a sampling of all federal announcements posted on the official OPM website. However no guarantee or warranty is made as to the total amount of job opportunities and any given vacancy announcement that may appear on. There are many variables beyond our control when it comes to how a job is advertised to the public. Therefore no guarantee or warranty is made as to the number of vacancy announcement positions that well be posted through the Web or made available for public competition. Because of the nature of the Internet any number of technical difficulties both on our reviewed organizational official web site and our Web Site could prevent any job from being reviewed by FCPS. However, the Web Site will take every effort to see that a particular defense intelligence organization’s official web site vacancy announcement postings are accessed via all U.S. government publicly available means in an attempt to match our Client to positions they qualify for.


15. RESUME RELATED RULES Acceptance: By purchasing any of our resume related services (resume writing, resume distribution and related services), you acknowledge reading and accepting these Terms and Conditions and you represent, warrant and agree that you are not in violation of our terms of use listed on this page. You further agree that, should you violate any of these terms you will cause us damages equal to or greater than the amount of your current purchase, which will be forfeited. You further agree that the Web Site has the right to edit the content of your resume based upon the recommendations of our professional resume writers. (a) Resume Orders, Delivery and Timing of your Order To ensure the quick processing of your order and get your resume completed within our 4 to 5 business day turnaround (depending on the complexity of on-line resume ordered) you must respond promptly to all requests for information. [Historical data at the time of this contract signing illustrates all Client contracts for this service have been completed by the Seller within the prescribed twenty [20] hour time limit.] (b) Procedures for Approving your Resume After you submit all the required information for your resume you will be provided a final draft for your approval. You have 3 business days to review the accuracy of your documents. After 3 business days your resume writing order will be closed and your order will be complete. Also at this time you will be advised to submit your resume in accordance with vacancy announcement closing timelines if the Client has requested a resume in support of a specific vacancy announcement. It remains the Client’s sole responsibility to ensure their resume is submitted on time and to the organization through its employment opportunity web site. (c) Information to be Included in your Resume Your resume can only be written based upon the information you send to us. All information you submit in compliance with the timing of sections 1 and 2 above will be included in your resume. If you fail to submit the correct information or omit information needed for your resume FCPS is not obligated to include this information after your resume has already been written. Should you wish to have this information included after your order is complete, limited category service Clients will have to pay an additional re-write fee. Full Service category clients who have paid in good standing may submit additional information at any point during their 365-day contract period and FCPS will add it to their existing on-line resume. It remains the Client’s responsibility to then submit changes to any federal on line organization/agency’s employment web site using their personal applicant home account. (d) Guarantees Our Federal Resume Writing Guarantee: If after reviewing your new resume used on a federal government agency/organization’s on-line personal account for 30 days you aren't satisfied with its content, FCPS will have your resume re-written for no charge and return to you a revised version within 14 business days. If for any reason your resume is not accepted by our targeted defense intelligence organization based on compliance, we will rewrite your resume at no cost to you. Important Notice: We take credit card fraud (including fraudulent chargebacks) very seriously. Every order is logged with complete contact information (including your computers internet IP address). Any attempt at fraud or fraudulent chargebacks will be reported to the appropriate law enforcement authorities and your ISP.


16. INTERVIEW PREPARATION SESSION. (a) Seller will expend up to a maximum of two [2] hours in one session assisting Client to prepare for an interview. This may be done in response to a notification to the Client by the Organization to arrange an interview, or may be done separately for Client preparation technique enhancement during interviews. Client and Seller will meet at a mutually agreeable location within the Washington D.C. area, or arrange for telephonic discussions for the purpose of conducting intensive interview preparation activities. (b) Client must notify the Seller within 12 hours of an interview preparation session appointment start time if they need to reschedule for any reason. The Client’s failure to notify Seller will constitute forfeiture of fee and require a subsequent payment, if Seller decides it is not possible to meet Client’s last minute request. In-person or telephonic interview preparation sessions will include as a minimum the following items. . Clothing, apparel and accessories. . Interview session scenario. . Probable Interview questions. . Interview techniques.


17. PREPARE ONE ON-LINE KSA APPLICATION: Seller will expend up to a maximum of twenty [20] hours reviewing or preparing a Client’s draft* on line job application to ensure it enables the Client to effectively compete and be considered for further referral, interview call and selection. Seller will either review a Client draft KSA write-up or prepare responses for one Organizational vacancy announcement. Seller reviews and incorporates substantive and contextual value, corresponds with Client via e-mail as required to optimize information presentation, and fine tunes Client’s draft KSAs to make it as competitive as possible. Seller provides Client an exclusive advantage by shaping the Client’s submission to satisfy formal as well as unspoken cultural submission criteria hiring and review board officials use. Seller will prepare responses for each mandatory and highly desired assessment factor listed for the VA. Seller’s responsibilities are completed when the Client’s on line job application is ready for final submission prior to the position’s announced closing date or twenty [20] hours have been expended in support of this service.


18. REVIEW, EDIT AND/OR PREPARE ONE COMPLETE ON-LINE RESPONSE. Seller affords FCPS Clients a $100.00 savings by reviewing or preparing in its entirety one complete draft vacancy announcement packet submission. Seller will prepare for Client submission one complete draft VA resume and KSA write up and provide to Client for review within seven business days.


19. EXECUTIVE CORE COMPETENCY [ECQ] PREPARATION. Seller will expend up to thirty [30] hours preparing one Executive Position [DISL/DISES] Essential Factors and Highly Desired Factors submission. Seller will correspond with Client via telephone or e-mail to request from Client all relevant background information in order to prepare focused responses for each essential and highly desired factor. Seller will prepare responses iaw Office of Personnel Management (OPM) Guide to SES Qualifications and shape responses in conjunction with known Federal Agency contextual preferences. Seller will provide Client draft ECQs for review responsibilities within fourteen business days and/or thirty [30] hours have been expended in support of this service.


20. FULL SERVICE CATEGORY SUPPORT. FCPS provides turn-key, cradle-to-grave support to paying clients. In 2008 DoD intelligence transitioned from the legacy Government Service Grade / Step system to the Defense Civilian Intelligence Personnel System (DCIPS). If the Client appears to be deemed potentially employable in defense intelligence or the federal government due to national origin, previous criminal activity, drug use or personal behavior, medical or psychological conditions, education and experience. Which pay band and work level the Seller believes the Client could effectively compete at while attempting to gain federal employment. Which job categories the Seller believes the Client can compete towards. Note: The Seller has been very successful marketing Clients to obtain employment at a defense intelligence community Organization and other federal Agencies in a number of categories outside the Client’s initial skill preference category or Pay Band [Grade] assumptions. (b) The Seller primarily provides services that assist Client efforts to obtain employment in the Washington D.C. area. The Seller operates and physically conducts Client support activities in the Washington D.C. area, but effectively and routinely corresponds with Clients worldwide to facilitate their long distance efforts to relocate to the Washington D.C. area. Clients shall make all necessary arrangements to attend interviews or travel accordingly. The Seller also assists Client efforts to obtain employment worldwide, frequently at Combatant Command (COCOM) and Federal Agency headquarters locations where the federal government maintains sizeable presence. It remains the Client’s responsibility to make all arrangements for travel accordingly. (c) The Client may take as long as they desire to review FCPS service offerings and shall make all necessary payment at the time of contract submission to obtain services for desired categories of support. The contract will become officially binding between the Client and the Seller upon the date that the Client’s payment clears a financial institution chosen by the Seller. The Seller will begin correspondence and support to comply with this agreement and services purchased thereafter. The Client’s failure to submit job vacancy applications in accordance with the mandatory closing date will be the fault of the Client alone, and not be held against the Seller as a breach of contract. (g) The Client is responsible for monitoring his email address that the Organization will use to provide notification updates to job application status changes. Upon Client notification by the Organization or any other federal agency via e-mail or telephonically that the Client has been selected for an interview, the Client shall correspond immediately with the Seller to prepare and arrange for an interview preparation session if they desire this service. The Seller will be responsive to the Client and facilitate arrangement for an in person or telephonic meeting to provide services to the Client in accordance with established guidelines. It is the Client’s responsibility to arrange and pay for long distance phone charges or internet service fees if a telephonic or VOIP interview up to two [2] hours is desired instead of a face to face meeting in the Washington D.C. area regardless of which category of services is obtained. The Seller is not liable for a Client’s failure to obtain employment under any circumstance. (h) Upon Client notification by the organization that they have been selected for a position within the federal Agency and is being offered conditional employment, they may consider an opportunity to consider the offer and request advice from FCPS. This Client is solely responsible for entering into all salary negotiations with an organization and FCPS is not responsible in any manner if they lose a job offer or do not obtain desired salary amounts. FCPS will provide recommendations to full service category Clients for helping them attempt to obtain a higher rate of starting salary within the offered Pay Band or additional incentives. The Client may then call back the organizational representative and request a counter offer if they desire to do so. At any time the Client may agree to any salary offers at their discretion. (i) Upon accepting a conditional job offer with the Organization the Client will comply with all prerequisites to obtain employment. Full Service Clients may continue to receive additional notifications from the Organization in response to other previously submitted applications and may contact the Seller to conduct additional interview preparation sessions during their 180 day period of contract. It is to the Client’s advantage to continue their attempts to obtain higher Pay Band conditional job offers until either this contract of services expires, or the Client formally reports for employee in processing upon completing all conditional job offer prerequisites. (j) The Client may terminate this contract of services at any point in time on a non refundable basis. The Seller is bound by this contract of services and may not unilaterally terminate it prior to its stated completion unless the Client violates provisions stated herein.


21. CANCELLATIONS, REFUNDS & CHARGEBACKS: (a) Cancellations: No cancellations are accepted for any reason.
